Andrew is a senior lawyer with 20 years of legal experience, including over a decade specialising in intellectual property litigation. Andrew’s practice encompasses most areas of intellectual property litigation with an emphasis on matters relating to protection of confidential information, trade mark disputes, passing-off and breaches of Part V of the Trade Practices Act, copyright, patent infringement and related disputes. He also has significant experience in general contractual disputes and, in particular, agreements for the licensing of intellectual property rights. Before being admitted to practice in 1993, Andrew was the Associate to Chief Justice Black and, prior to that, Justice C A Sweeney in the Federal Court of Australia.
Andrew has advised and acted for a wide variety of clients ranging from multi-national mining and manufacturing corporations to local medium and small business enterprises. His clients include companies and individuals in fields as diverse as heavy transport manufacturing, automotive, electrical and electronic industries through to the retail, clothing, fashion, fine arts and jewellery sectors.
He has recently:
• represented a Swiss electronics company in relation to patent infringement and revocation proceedings in the Federal Court of Australia concerning an electronic audio signal processing device;
• advised and acted for a Victorian designer and manufacturer/importer in design validity and infringement proceedings relating to high performance light emitting diode automotive lamps;
• advised a European manufacturer of high quality confectionary in relation to both 2D and 3D trade marks and represented that company in proceedings in relation to the possible registration of its 3D shape trade mark in Australia;
• advised both US and Australian designers and manufacturers of jewellery in relation to enforcement of copyright in a number of jewellery works;
• represented a designer and manufacturer of heavy transport equipment for the Australian transport industry in complex breach of confidence and copyright infringement litigation in the Federal Court of Australia.
Andrew is also the treasurer and immediate past secretary of the Trans-National Committee of Management of the Intellectual Property Society of Australia and New Zealand and a past chair of the society’s Victorian Committee. He is a co-author of Australian Patent Law, an intellectual property text published by LexisNexis Butterworths. He also contributes to various journals and in-house publications on topics ranging from director’s duties to passing off and implied licences to repair.
